These Terms of Service ("Terms") are a legally binding agreement between you and Acloudidea (Pty) Ltd (registration number 2026/789189/07), trading as Amusika. They govern your use of the Amusika mobile app, the web app at app.amusika.com, the website at amusika.com and the Amusika WhatsApp assistant (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Key things to know

  • Amusika connects buyers and sellers; it isn't part of the sale. Deals, payment and delivery are agreed between the people involved.
  • Payments go directly between users. Amusika doesn't hold or refund money for goods, transport or hire, so only pay when you're sure the seller and the goods are genuine.
  • Offers come first. A buyer makes an offer; chat opens when the seller accepts it.
  • Be honest. Listings, photos, offers and ratings must be true, or we may remove them or close the account.
  • Amusika is free until 30 June 2027. After that, some features for sellers will need a paid membership, and nobody is charged without choosing to subscribe.
  • Your phone number stays private unless you choose to share it.

These points are a summary. The full Terms below are what apply.

1. Definitions

  • "Amusika", "we", "us" or "our" means Acloudidea (Pty) Ltd, a private company registered in South Africa with registration number 2026/789189/07, trading as Amusika.
  • "User" or "you" means anyone who uses the Services, in any role.
  • "Seller" means a user who offers goods, transport, equipment or services, including farmers, transporters and equipment owners.
  • "Buyer" means a user who makes an offer on, requests or hires something offered through the Services.
  • "Listing" means any produce, livestock, equipment, transport or farm support post published on the Services.
  • "Deal" means an agreement between a buyer and a seller that starts when the seller accepts the buyer's offer.

2. Our role

In short We run the marketplace; the deal itself is between buyer and seller.

2.1Amusika is a marketplace. It helps buyers and sellers find each other, agree terms and keep a record of their deals.

2.2Amusika is not a party to any sale, hire or transport agreement made between users. We do not own, inspect or deliver the goods, vehicles or equipment that are listed, and we do not guarantee their quality, safety, legality or availability.

2.3Amusika does not hold, collect or transfer payments between users. Buyers and sellers agree the price and the way of paying between themselves.

3. Eligibility and accounts

3.1You must be at least 18 years old and able to enter into a binding agreement to use the Services.

3.2You must give accurate information when you create your account and keep it up to date. You may hold more than one role (farmer, buyer, transporter) on one account.

3.3You sign in with your phone number and a one-time code. Keep your phone and your codes secure; you are responsible for activity on your account. Tell us at once if you think someone else has used it.

3.4You may delete your account at any time. Deleting it does not cancel deals you have already agreed.

4. Listings and posts

4.1When you publish a listing or post, you must:

  • describe the goods, equipment or service accurately, including type, quantity, quality and price;
  • use photos of the actual item, taken by you or with permission;
  • state the location truthfully; and
  • keep stock and availability up to date, and close or mark the listing sold when it is no longer available.

4.2You may not list illegal, stolen, counterfeit or dangerous goods, items you do not own or are not authorised to sell, or anything that infringes another person's rights.

4.3We may remove or edit any listing or post that breaks these Terms or that we reasonably believe is misleading or unsafe.

5. Offers, chat and deals

In short Offer, accept, chat, reserve, hand over, rate.

5.1A buyer starts by making an offer on a listing (a price and, where relevant, a quantity) or by asking one of the set questions. Chat between the buyer and the seller opens once the seller accepts an offer.

5.2A seller may accept, decline or counter an offer. An accepted offer is a commitment by both sides to complete the deal in good faith.

5.3After accepting, the seller may reserve the agreed quantity. A reservation takes that quantity off what other buyers see; a listing shows as sold out when nothing is left. If a deal does not go ahead, the seller should release the reservation so the quantity returns to the listing.

5.4When the goods have changed hands, the seller marks the deal completed or the buyer marks it received. Each side may then rate the other once.

5.5Buyers must only make offers they intend to honour. Sellers must only accept offers they can fulfil.

6. Payments between users

In short You pay each other directly, so check before you pay.

6.1Payment for goods, transport and hire is made directly between the buyer and the seller, by a method they agree.

6.2Prices are set by sellers and shown in US dollars. Amounts shown in other currencies are converted for guidance only. Transport is priced separately unless a listing says otherwise.

6.3Do not pay until you are satisfied that the seller and the goods are genuine. Amusika cannot recover payments made between users.

6.4Any refund for goods, transport or hire is a matter between the users involved.

7. Membership

In short Free until 30 June 2027; after that, paid features are optional and announced in advance.

7.1The Services are free to use until 30 June 2027.

7.2After that date, some features for farmers, transporters and equipment owners will require a paid membership. We will publish the prices and what each membership includes in the app before any charge applies. You will only be charged if you choose to subscribe.

7.3Buyers can browse listings and make offers without a membership.

7.4Membership fees, renewals and any refunds will follow the terms shown when you subscribe, and the consumer law that applies to you.

8. Transport, equipment hire and farm services

In short The vehicle or machine that arrives must match the listing.

8.1Transporters and equipment owners must hold any licences, permits and insurance that their vehicle, machine or work requires, and must deliver the agreed service safely and on time.

8.2Every vehicle and piece of equipment must be listed with accurate, current photos, including the number plate where the vehicle is registered. The vehicle or equipment that arrives must match the listing.

8.3Before loading goods, paying or handing over equipment, check the vehicle, number plate and person against the listing. You may refuse any vehicle or equipment that does not match, and should report it to us.

8.4Listing a vehicle or machine you do not own or control, or sending a different one from the one advertised, is misrepresentation and may lead to suspension or removal.

8.5Hire and transport arrangements, including price, timing, fuel and responsibility for damage, are agreed between the users involved.

9. Community, messages and the assistant

9.1In chat, Village Square and anywhere else on the Services, you must not harass, threaten or abuse anyone, post spam, scams or hate speech, impersonate another person, or share false or dangerous advice.

9.2Your phone number is not shown to other users. You may choose to share it in a chat; once shared, it is visible to that person.

9.3Answers from "Ask Amusika", prices, weather and news are general information only. They are not professional, veterinary, legal or financial advice, and AI-generated answers can be wrong. Check important decisions with a qualified person.

10. Ratings

10.1Ratings must be honest and based on a real, completed deal. You may not offer or accept anything in exchange for a rating, or rate yourself through another account.

10.2Ratings are shown to other users. We may remove ratings that break these Terms.

11. Your content

11.1You keep ownership of the content you post, including photos and descriptions.

11.2You grant Amusika a non-exclusive, royalty-free licence to host, display, adapt (for example, resize) and share that content for the purpose of operating and promoting the Services. This licence ends when your content is deleted, except for copies already shared with other users or retained as required by law.

11.3You confirm that you have the right to post your content and that it does not infringe anyone else's rights.

12. Our intellectual property

The Amusika name, logo, app and website belong to Acloudidea (Pty) Ltd or its licensors. You may not copy, modify or distribute them, or use our name or logo in a way that suggests we endorse you, without our written permission.

13. Suspension and termination

In short Break the rules and we may restrict or close your account.

13.1We may warn, restrict, suspend or close an account, or remove content, if we reasonably believe that the account holder has breached these Terms, acted fraudulently or unlawfully, or put other users at risk.

13.2Where it is safe and lawful to do so, we will tell you why and give you an opportunity to respond.

13.3Sections 2, 6, 11, 14, 15, 16 and 17 survive the closure of your account.

14. Disclaimers

14.1We provide the Services "as is" and "as available". We work to keep them running and accurate, but we do not warrant that they will be uninterrupted, error-free or always available.

14.2We are not responsible for the conduct of users, for goods, transport or hire arranged between users, or for services provided by third parties such as WhatsApp, mobile networks or payment providers.

15. Limitation of liability

In short Our responsibility is limited, except where the law says it can't be.

15.1To the extent permitted by law, Amusika is not liable for any indirect or consequential loss, or for loss of profit, income, data or business opportunity, arising from your use of the Services.

15.2To the extent permitted by law, our total liability to you for any claim relating to the Services is limited to the membership fees you paid us in the 12 months before the claim arose.

15.3Nothing in these Terms excludes or limits any right you have, or any liability we have, that cannot be excluded or limited under applicable law, including South Africa's Consumer Protection Act, 2008.

16. Indemnity

To the extent permitted by law, you indemnify Amusika against losses and reasonable costs we incur as a result of your breach of these Terms, your content, or your dealings with other users.

17. Disputes

In short Sort it out with the other person first; we can step in on rule-breaking, not on payments.

17.1Between users. A dispute about a deal is between the buyer and the seller. Try to resolve it directly, in the Amusika chat where possible. If you cannot, contact us at [email protected] with the listing and what happened. We may review the chat and the listing and take action under section 13, but we do not decide or enforce payments between users.

17.2With us. If you have a complaint about Amusika, contact us first at [email protected] and we will try to resolve it within 30 days. If it is not resolved, either party may refer it to the courts set out in section 18, or to any consumer body that the law allows you to approach.

18. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction. This does not remove any protection given to you by the law of the country where you live.

19. Changes to these Terms

19.1We may update these Terms to reflect changes to the Services or the law. The effective date at the top shows when they last changed.

19.2If we make a material change, we will notify you in the app or by message before it takes effect. If you continue to use the Services after that, the updated Terms apply. If you do not agree, you may close your account.

20. General

20.1These Terms, together with our Privacy Policy, constitute the entire agreement between you and Amusika regarding the Services.

20.2If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

20.3A failure or delay by us in enforcing a right does not waive that right.

20.4You may not assign your rights under these Terms. We may assign ours to an entity that takes over the Services, and we will notify you if we do.
